Terms and Conditions
General Terms and Conditions (GTC)
1) Scope
These General Terms and Conditions (GTC) apply to all offers and contracts between smartifyGo , represented by Francisco Monteiro Pereira , Industriestrasse 30, 8302 Kloten (hereinafter "Seller") and customers (hereinafter "Customer") regarding goods and/or services offered via this website. Any differing terms and conditions of the Customer shall not apply unless the Seller expressly agrees to their validity in writing.
2) Conclusion of contract
Product and service descriptions are non-binding. By completing the order process or by accepting an offer in writing, the customer submits a binding offer. The contract is concluded when the seller confirms the order by email, provides the service, or ships the goods. If no acceptance is received within 5 days, the offer is considered rejected.
3) Cancellation / Return
Under Swiss law, there is generally no statutory right of withdrawal for distance selling. The seller does not grant a voluntary right of return. Returns are only possible in the case of defective or faulty goods within the scope of the statutory warranty for defects. The defect must be reported immediately, at the latest within 7 days of receipt.
4) Prices and Payment
All prices are in CHF including VAT, unless otherwise stated. Shipping and additional costs are shown separately. Accepted payment methods: Shopify Payments (Stripe) , PayPal , and TWINT . For advance payments, the amount is due immediately upon conclusion of the contract. In case of late payment, the seller may suspend deliveries and charge reminder fees and default interest within the legally permissible limits.
5) Delivery and transfer of risk
Deliveries are generally made to the DACH region (Switzerland, Germany, Austria) to the address provided by the customer. If a shipment cannot be delivered due to incorrect address information or failure to collect it, the customer will bear any resulting additional costs. Risk passes to the customer upon handover to the transport company. Self-collection is only possible if expressly offered.
6) Warranty / Defects
The statutory warranty for defects applies. Obvious defects must be reported within 7 days of receipt. The seller is entitled to remedy the defect by repair or replacement. If the remedy fails, the customer is entitled to the statutory rights. Warranty claims do not apply in cases of normal wear and tear, improper use, or external influences.
7) Promotional vouchers
Promotional vouchers are only redeemable within the specified period, are non-transferable, and cannot be combined with other offers. Cash payment is not possible. Generally, only one voucher can be redeemed per order. Any remaining balance expires unless otherwise stated.
8) Liability
The seller's liability is limited – to the extent permitted by law – to intentional and grossly negligent conduct. For slight negligence, the seller is only liable for breaches of essential contractual obligations (cardinal obligations); in this case, liability is limited to the foreseeable, typical contractual damages. Mandatory statutory liabilities remain unaffected.

The privacy policy published on this website applies.
10) Applicable law and jurisdiction
Swiss substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the place of jurisdiction is their place of residence. For businesses, the exclusive place of jurisdiction is 8302 Kloten .
